1. Sanctuary State Law (Senate Bill 54 - California Values Act)
Enacted in 2017, this law limits the cooperation between local law enforcement and federal immigration authorities. It aims to protect the privacy of immigrants by prohibiting local law enforcement from asking about immigration status and restricts their ability to share this information with federal bodies unless required by federal law.
2. California Dream Act
This act allows students who meet certain requirements similar to those in the federal DACA (Deferred Action for Childhood Arrivals) program to apply for state financial aid for college. It does not confer legal immigration status but helps eligible undocumented students afford higher education.
3. AB 540 (Nonresident Tuition Exemption)
Assembly Bill 540 allows eligible undocumented students, including DACA recipients, to pay in-state tuition rates at public universities and colleges in California.
4. Health Care for All
California provides healthcare benefits to all residents, including undocumented children and young adults up to the age of 26, under the Medi-Cal program, regardless of their immigration status.
5. Driver’s Licenses for Undocumented Residents (AB 60)
Since January 2015, California has allowed undocumented immigrants to obtain a driver’s license. Applicants must meet all the requirements for a driving license except proving lawful presence in the United States.
6. Immigrant Worker Protection Act (AB 450)
This law provides protections for immigrant workers and limits how employers can cooperate with federal immigration enforcement at workplaces. It requires employers to demand proper court documents before allowing immigration agents access to the workplace or employee records.
7. Public Defender’s Office: Immigration Support
Some counties in California have allocated resources to help defend immigrants in deportation or removal proceedings, recognizing the complexity and stakes of these legal processes.
8. One California Initiative
This initiative funds the provision of immigration services, particularly focusing on legal aid, community education, and citizenship services to assist immigrants at various stages of their legal process in the state.
9. SB 668 - Work Authorization
This state law facilitates the process for immigrants who are victims of certain crimes (and are cooperating with law enforcement) to apply for work authorization.
10. Expansion of Non-Discrimination Policies
California has laws that forbid discrimination based on immigration status in housing, employment, and other areas, providing broad protections for immigrants against exploitation and abuse.
